Terms of Service

Please read these Terms of Service ("Terms") carefully. Sections 4 to 9 and 17 to 20 are especially important — they limit what Moodflow is, what it is not, and what we are responsible for. By using Moodflow, you accept these Terms in full.

1. Agreement to these Terms

By downloading, accessing, or using the Moodflow app or the website moodflow.co (together, "Moodflow", "the app", "the website", "the Service", and the provider "we", "us", "our"), you agree to be bound by these Terms and by our Privacy Policy, and you confirm that you are responsible for complying with any laws that apply to you locally. If you do not agree with any part of these Terms, you must not access the website or use the app.

2. Eligibility and capacity to contract

To use Moodflow you must be old enough to form a binding contract and to consent to the processing of your data where you live (generally 16 in the EEA, or the lower minimum digital‑consent age set by your country — 14 in Spain), and you must not be barred from using the Service under any applicable law. If you are below that age, you may use Moodflow only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use. By using Moodflow you represent that you meet these requirements and that any information you provide is accurate. We may refuse, suspend, or terminate access where we reasonably believe these requirements are not met.

3. Who we are

Moodflow is operated by Walter Monecke, based in Spain. The app is available on the Apple App Store and Google Play, and the website is available at moodflow.co. The materials in the app and on the website are protected by copyright and trademark law and are the property of Walter Monecke, except for third‑party materials that remain the property of their respective owners.

4. What Moodflow is — and what it is NOT

Moodflow is a personal journaling, mood‑tracking, and self‑reflection tool intended for general well‑being, self‑awareness, and entertainment purposes only.

Moodflow is NOT a medical device and is NOT a healthcare service. It is not intended or designed to diagnose, treat, cure, mitigate, monitor, or prevent any disease, disorder, illness, or health condition, whether physical, mental, emotional, hormonal, or reproductive. Nothing in Moodflow — no text, score, rating, chart, trend, correlation, insight, summary, reminder, notification, prediction, or other output — is, or should be treated as, medical, psychiatric, psychological, therapeutic, diagnostic, nutritional, or any other professional advice.

We are not a doctor, therapist, counselor, or healthcare provider, and using Moodflow does not create any doctor–patient, therapist–client, or other professional or fiduciary relationship between you and us.

5. Not for emergencies or crises

Moodflow is not an emergency or crisis service. If you are experiencing a medical or mental‑health emergency, a crisis, or thoughts of self‑harm or suicide, do not rely on the app — contact your local emergency number, go to the nearest emergency room, or call a crisis helpline immediately. Moodflow cannot and does not provide emergency help, monitoring, or intervention of any kind.

6. No diagnosis, no professional judgment, no guarantees

Any information the app produces — including but not limited to mood scores, ratings, statistics, charts, graphs, trends, patterns, correlations, streaks, summaries, "insights", reminders, and any cycle, period, ovulation, fertility, or pregnancy estimates — is generated automatically from data you enter, is provided for general information and self‑reflection only, and:

  • may be inaccurate, incomplete, outdated, or simply wrong;
  • is not a diagnosis, medical opinion, or professional recommendation, and must never be treated as one;
  • must not be used as a basis for any medical, psychological, health, reproductive, financial, or other important decision.

Always consult a qualified professional (such as a physician, psychologist, or other licensed expert) before making any decision relating to your health, symptoms, medication, treatment, mental well‑being, fertility, contraception, pregnancy, or lifestyle. We make no representation, warranty, or guarantee of any kind — express or implied — that the app is accurate, reliable, complete, effective, or fit for any purpose, or that using it will produce any particular result or improve any condition.

7. Cycle, fertility, and reproductive‑health features

Any menstrual‑cycle, period, ovulation, fertility, or pregnancy‑related features are provided for general awareness and personal tracking only. They are based on estimates and the data you enter, and are frequently inaccurate. They are NOT a contraceptive method, NOT a fertility or medical treatment, and NOT a family‑planning service. You must not rely on them to prevent pregnancy, to conceive, to detect pregnancy, or for any medical or reproductive decision, and you must not use them as a substitute for professional medical care or contraception. Any use of these features for such purposes is entirely at your own risk.

8. Your interpretation, your decisions, your risk (Assumption of Risk)

You are solely responsible for how you interpret, rely on, or act upon anything in Moodflow. You acknowledge and agree that:

  • any deduction, interpretation, or conclusion you draw from the app is made by you alone, and we do not warrant its correctness;
  • to the maximum extent permitted by applicable law, we are not responsible or liable for any interpretation you make, any decision you take or fail to take, any action or inaction, or any resulting consequence — including any misdiagnosis, self‑diagnosis, missed or delayed diagnosis, forgone or delayed treatment or care, or any physical, mental, emotional, reproductive, financial, or other harm — arising out of or relating to your use of, or reliance on, the app or any content, feature, data, or output within it;
  • you use Moodflow entirely at your own risk, and Moodflow is only a tool to help you record and reflect on your daily life and moods.

9. Your data, backups, and data loss

Moodflow is designed to store your entries on your own device, with optional backup to your own cloud storage as described in our Privacy Policy. You are responsible for maintaining your own backups. To the maximum extent permitted by law, we are not liable for any loss, corruption, or inability to access your entries, photos, or other data, however caused, including loss resulting from device failure, uninstalling the app, account deletion, sync or backup errors, or third‑party service outages.

10. Accounts, subscriptions, and billing

You can use Moodflow's core features for free. Some features require an account. Moodflow also offers a paid subscription, Moodflow Plus, purchased through the Apple App Store or Google Play. All features except the Cloud Backup feature become active when the Plus trial period begins; the Cloud Backup feature becomes active once payment has been received by the respective app store. Purchases, billing, renewals, refunds, and cancellations are handled by Apple or Google under their terms, and you agree to comply with them. You are responsible for keeping your account credentials secure and for all activity under your account.

11. Your content and the rights you grant

You keep ownership of the entries, notes, photos, and other content you create in Moodflow ("Your Content"). Most of Your Content stays on your device; some is stored on our servers only where a feature requires it (for example, photo backup for Moodflow Plus subscribers, as described in our Privacy Policy).

You are solely responsible for Your Content and for ensuring you have the right to store and back it up — including any photos of, or information about, other people. You represent and warrant that Your Content does not infringe anyone's rights and does not contain unlawful material.

Solely so that we can operate the features you choose to use, you grant us a limited, worldwide, non‑exclusive, royalty‑free license to host, store, back up, transmit, and display Your Content — only back to you, and only as needed to provide the Service. This license lasts only while we store the relevant content and ends when it is deleted; it gives us no right to use Your Content for any other purpose. We never sell Your Content, use it for advertising, or share it except with the service providers strictly needed to run these features.

12. Feedback and suggestions

If you send us ideas, suggestions, feature requests, or other feedback about Moodflow (including through the in‑app feedback prompt), you agree that we may use it freely and without restriction, obligation, attribution, or compensation to you, and you grant us a perpetual, irrevocable, worldwide, royalty‑free license to use and incorporate that feedback into the Service in any way. Feedback is given voluntarily and is not confidential.

13. Acceptable use

You agree not to misuse the Service, including by: abusing, overloading, probing, or attempting to disrupt the app, its APIs, or its infrastructure; attempting to gain unauthorized access to any account, system, or data; reverse‑engineering, decompiling, or copying the app except as permitted by law; or using the Service for any unlawful purpose. We may suspend or terminate your access or account if your conduct abuses the app's APIs, threatens the platform's integrity or other users, or violates these Terms.

14. Third‑party services and content

Moodflow relies on and links to third‑party services and content (such as maps, place data, weather data, background images, sign‑in, storage, and payment providers). This third‑party material may be inaccurate, incomplete, or unavailable, and it is provided by its respective owners under their terms and privacy policies. We do not control, endorse, or take responsibility for any third‑party service, website, or content, and your use of them is at your own risk.

15. Intellectual property

The Moodflow name, logo, app, website, design, and content (excluding your own entries and third‑party materials) are owned by Walter Monecke and protected by intellectual‑property laws. You retain ownership of the content you create in the app. We grant you a limited, personal, non‑exclusive, non‑transferable, revocable license to use the app for your own personal, non‑commercial use, subject to these Terms.

16. Errors, changes, and availability

The materials in the app and on the website may contain technical, typographical, or other errors. We do not warrant that any materials are accurate, complete, or current, and we may change, suspend, or discontinue the app, the website, or any feature at any time, with or without notice, without liability to you. The Service is provided on an "as available" basis and may be unavailable from time to time.

17. Disclaimer of warranties ("AS IS")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOODFLOW, THE APP, THE WEBSITE, AND ALL CONTENT, FEATURES, DATA, AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. We expressly disclaim all warranties and representations, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non‑infringement, and any warranty that the Service will be uninterrupted, secure, error‑free, or will meet your requirements or produce any particular result. No advice or information, whether oral or written, obtained from us or through the Service creates any warranty not expressly stated in these Terms.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WALTER MONECKE, MOODFLOW, OR ANY OF ITS CONTRIBUTORS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR FOR ANY PERSONAL, MEDICAL, PSYCHOLOGICAL, EMOTIONAL, REPRODUCTIVE, OR HEALTH‑RELATED HARM OR OUTCOME, arising out of or in connection with your use of, reliance on, or inability to use the Service or any content or output within it, whether based on contract, tort (including negligence), statute, or any other legal theory, and even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the total amount you actually paid us (or through the relevant app store for Moodflow Plus) in the twelve (12) months before the event giving rise to the claim, or (b) EUR 50.

19. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Walter Monecke and Moodflow from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Service; (b) your reliance on, interpretation of, or decisions based on the app or its outputs; (c) your violation of these Terms or any law; or (d) your infringement of any third‑party right.

20. Force majeure

We are not liable for any failure or delay in performing, or for any loss or damage, caused by events or conditions beyond our reasonable control — including internet or network failures; outages, suspensions, or changes by third‑party providers (such as hosting, storage, sign‑in, payment, maps, or weather providers); app‑store actions; power failures; natural disasters; epidemics or pandemics; government action; labor disputes; war; terrorism; or other force‑majeure events. While such an event continues, our obligations are suspended to the extent affected.

21. Your statutory consumer rights

Nothing in these Terms excludes, restricts, or limits any right or remedy you have under mandatory consumer‑protection law that cannot lawfully be excluded or limited — including, where applicable, liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for gross negligence or willful misconduct. If you are a consumer, you benefit from the mandatory provisions of the law of your country of residence, and the disclaimers and limitations in these Terms apply only to the extent permitted by that law. Where any exclusion or limitation above is not permitted, our liability is limited to the minimum allowed by law.

22. Severability and survival

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permissible and severed from the remaining provisions, which will remain in full force and effect. The disclaimers, limitations of liability, indemnification, content and feedback licenses, and intellectual‑property provisions survive any termination of these Terms or of your use of the Service.

23. Changes to these Terms

We may revise these Terms at any time. When we make material changes, we will update the "Last updated" date above. By continuing to use the website or the app after changes take effect, you agree to be bound by the current version of these Terms.

24. Privacy

Your use of Moodflow is also governed by our Privacy Policy, which explains how we handle your information.

25. Entire agreement

These Terms, together with the Privacy Policy and any app‑store terms that apply to your purchases, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on that subject. Our failure to enforce any provision is not a waiver of it.

26. Governing law and jurisdiction

These Terms and any dispute arising out of or relating to them or to the Service are governed by the laws of Spain, without regard to its conflict‑of‑law provisions. If you are a consumer, you may also rely on the mandatory law of, and bring proceedings in, your country of residence, and nothing here deprives you of that protection. Before starting any formal proceedings, we ask that you first contact us at hellomoodflow@gmail.com so we can try to resolve the matter informally.
